Spent convictions cover the idea that some criminal records are treated as if they never happened after a period, enabling individuals to move on from past offences in many ordinary, non-criminal contexts. A solicitor in this area advises about which convictions are spent, how this affects disclosure, and how to avoid unnecessary or unfair disclosures in employment, licensing, and housing checks. They also help with exemptions from disclosure, and with applying for certificate of conviction status where applicable. The work often involves navigating the Rehabilitation of Offenders Act 1974 and related guidelines.

Where a solicitor protects your position

A spent conviction can still affect certain high-security roles or positions requiring enhanced DBS checks. The solicitor explains which jobs or licenses trigger ongoing disclosure, and helps assess when a disclosure obligation ends, and what can be done if a conviction appears on a background check despite it being spent.
