In England, Punishment covers the sentencing stage after conviction or guilty plea, including how penalties are decided and carried out. A solicitor in this area helps clients understand available disposals, such as fines, community orders, custodial sentences, or suspended sentences, and how these might affect rights and future prospects. They draft and present mitigation to the sentencing judge, obtain pre‑sentence reports, and coordinate appeals or reviews if the sentence seems disproportionate or procedurally flawed.
What a solicitor handles in these matters
They prepare and submit evidence, character references, and impact statements; liaise with probation, prison services, and the courts; and advise on the implications of terms like community orders, curfews, rehabilitation activity requirements, or licence conditions. The process is shaped by the Sentencing Council guidelines, the court’s discretion, and statutory frameworks governing penalties and eligibility.
