This area covers how employment law intersects with childcare needs, including parental leave, shared parental leave, flexible working and protection from discrimination based on family status. A solicitor practising in this field advises on taking or negotiating leave, requesting flexible hours, and handling disputes with employers if these rights are challenged or denied. They also help with recall and return-to-work issues, and with claims where childcare arrangements affect pay or progression.
The key decision points involve exercising rights under the Employment Rights Act and the Flexible Working Regulations, and navigating potential disciplinary or redundancy risks linked to childcare needs. A solicitor provides guidance on deadlines, documents to gather (such as birth certificates and employer policies), and the procedural steps for early resolution or tribunal action where rights are breached.
