Retrospective checks in employment involve reviewing and validating past employee records and disclosures after they have occurred. A solicitor in this area helps manage requests for post-hoc verification of qualifications, references, identity, right to work, and prior conduct, and responds to data subject access or regulator inquiries. They draft and negotiate responses, advise on data protection and privacy implications, and coordinate with HR and external bodies to resolve discrepancies or disputes arising from historic checks.
Retrospective checks often require navigating data protection laws, contract terms, and employer obligations when re-evaluating an employee’s or candidate’s history. The solicitor handles the gathering and sharing of information, compliance with the Data Protection Act and GDPR, and ensures accurate, legally defensible records that withstand scrutiny by tribunals or regulators.
