Identification evidence covers how a person is linked to a crime through recognition or parade procedures, and how courts assess the reliability of such identifications in the criminal process. A solicitor in this area handle issues arising from eyewitness accounts, video or photo identification, and identity parades, including applications to exclude or admit identification evidence and challenges to identifications. The work involves advising on disclosure, gathering related material, and representing clients at police stations and in court when identity is contested.
What a solicitor handles in these matters
Solicitors manage the procedural complexities of identification evidence, including the conduct of identity parades, matching procedures to standards, and advising on admissibility and reliability. They handle related disclosure, instructions for experts on lineups, and communications with police, prosecutors and the court to safeguard a client’s position when identification is disputed.
