Non-consensual adoption covers cases where a child is placed for adoption despite a parent or guardian not agreeing to it, typically driven by the child’s welfare. In England, a local authority may initiate care proceedings and pursue an adoption order under the Adoption and Children Act 2002, with permanency secured through court order after welfare investigations, best interests assessments, and involvement of an adoption panel. A solicitor drafts and argues the application, handles evidence, guardianship and contact arrangements, and represents the client in family proceedings throughout the process.
What a solicitor handles in these matters
The process hinges on welfare judgments, the availability of care plans, and the court’s decision on adoption. The solicitor coordinates social services reports, legal submissions, and any appeals, while safeguarding the child’s interests and ensuring compliance with court directions and timescales. Professional accountability, including regulated conduct and client safeguarding, underpins the representation.
