Occupational leases cover the rights to occupy commercial premises for business purposes, typically as a tenant under a short or long lease when the focus is on occupation and use rather than ownership of the land. A solicitor in this area drafts, negotiates and finalises terms for the lease, including rent, service charges, repairing responsibilities, and user restrictions; advises on renewals, assignments, or exits; and helps with notices, dilapidations, and any landlord-tenant disputes that arise in the course of occupation.
The solicitor handles provisions, rent review mechanics, repairing covenants, guarantees, and break options, together with any related notices and registration. They coordinate with landlords, tenants, and property managers, identify potential liabilities, and ensure terms align with statutory protections and market practice. Complex scenarios may involve multiple parties, insolvency risk, or redevelopment constraints that affect occupation.
