Liquidated damages are a contractual sum fixed in advance to compensate breach, a concept used in English contract law. A solicitor in this area drafts, reviews and negotiates such clauses to ensure they are a genuine pre-estimate of loss and not a penalty. They check how the clause interacts with other damages, exclusions, or liquidated sums, and advise on incorporation, enforceability, and possible court or arbitration steps if a breach occurs.

What a solicitor handles in these matters

The clause must be precisely drafted in terms of calculation, cap and timing, with clear reference to measurable loss. The solicitor explains the limits of recoverability, ensures the mechanism aligns with existing contract terms, and flags any risk of disproportionate or unenforceable penalties, safeguarding the client’s position through appropriate drafting and negotiation.

Mike Elliott

Tagged solicitor Mike Elliott

I used Mike Elliott for a dispute I had with a contractor. The service was excellent. Mike was really good at both marshalling the arguments for my case and taking the emotion out of it so that we put a clear and logical position to the other side. They quickly settled without me needing to commence full legal proceedings. I would fully recommend to anyone in a similar position to use Mike.
