Admissions and Exclusions covers decisions about whether a child can be admitted to a particular school and how a school handles disciplinary exclusions. A solicitor in this area deals with the processes by which a school or local authority decides on a pupil’s place or removal, and the appeals or reviews that follow. It includes challenging or defending admission decisions, and representing clients at admission appeal panels, as well as handling formal exclusions or disciplinary measures that could affect a child’s education.
The solicitor drafts and submits appeal documentation for admission refusals, gathers supporting evidence from parents and schools, and represents clients at independent admission appeal panels. For exclusions, they prepare case papers, liaise with school staff, gather medical or safeguarding evidence, and represent the parent or guardian at disciplinary or appeals hearings. They may also advise on accompanying rights, such as SEN assessments or Education Welfare considerations, and navigate deadlines and procedural requirements to protect the pupil’s education.
