This area covers arranging and securing specialist and residential school placements for children with complex needs under England’s education system. It involves navigating assessments, EHC plans, and the processes used to secure appropriate schooling through local authorities and health partners. A solicitor in this field helps families gather evidence, prepare and lodge education, health and care plan cases, and, where needed, challenge local authority decisions or access appropriate residential provision via the SEND Tribunal. It matters because getting the right placement can have a lasting impact on a child’s development and wellbeing.
The most important decisions concern a child’s education, health and social outcomes, including eligibility for an Education, Health and Care plan and securing a specialist or residential placement. A solicitor provides guidance on deadlines, evidential requirements, rights of appeal, and the procedures of the SEND Tribunal and local authorities, including independent assessments and placements.
