This work covers advising on changes to a defined part of a business and the employment consequences. A solicitor helps assess how restructuring, relocation, or growth affects employees and their contracts, and how to manage risk under employment law. They draft or revise change letters, update staff terms, review redundancy and redeployment options, and advise on consultation obligations with staff and trade unions. They also identify potential discrimination or whistleblowing issues arising from the change and plan appropriate mitigations.
The act of altering a business unit can lock in significant choices, such as transfer of staff, changes to terms, or new reporting lines. A solicitor clarifies the legal steps to protect the client’s position, including timely notices, documentation, and avoidance of unlawful detriment, with attention to deadlines and proper record-keeping.
