Adoption from care covers securing a permanent family for a child who is looked after by a local authority, usually through care proceedings and a placement order. A solicitor in this area drafts and files the adoption application, prepares care plans and section 31 orders, gathers evidence, liaises with the local authority, the child’s guardian ad litem, prospective adopters and any birth relatives, and represents the client at court hearings in the family courts. The process is shaped by the courts’ timetables, safeguarding checks, and thresholds for adoption.
Why this work is usually handled by a solicitor
They draft and file the adoption petition, gather the local authority's care plan, seek the court's consent orders, and coordinate with the guardian ad litem, the adopters, and birth relatives. They attend and represent the client at final adoption hearings and ensure required safeguarding checks and placement orders are in place.
