This area covers the response to cyber security incidents affecting organisations, including data breaches, ransomware events and other unplanned system compromises. A solicitor helps assess legal risks, prepare and review incident response plans, draft notices to regulators and affected individuals, and coordinate with IT security teams. They also advise on regulatory reporting, potential liability, negotiations with insurers, and the steps needed to restore operations and protect data subjects after an incident.
Why this work is usually handled by a solicitor
A regulated professional handles notifications to the Information Commissioner’s Office and affected individuals, supports rights requests, and ensures compliance with the UK GDPR and the Data Protection Act 2018. They advise on record-keeping, data mapping, and safeguards to minimise harm, with emphasis on regulatory accountability and the protection of client interests following a breach.
