This area covers the Home Office checks into whether an applicant is of good character and suitable to be granted or retained permission to stay. A solicitor practising in this field gathers and organizes evidence about criminal records, cautions, civil penalties, previous immigration histories, and any conduct issues, then prepares representations to the Home Office or UK Visas and Immigration. They may also draft or collate character references, document rehabilitation, and advise on how the decision affects visas, settlement, or asylum outcomes. Where needed, they assist with appeals or related proceedings.
The solicitor handles the specific evidence, rules and complications governing suitability: how criminal records are disclosed, how cautions are treated, disclosure rules in visa applications, and the impact of past conduct on current and future immigration rights. They coordinate evidence, advise on required documentation, and manage interactions with Home Office caseworkers and, if necessary, the appeals process.
