Mediation is a voluntary, structured process in which a neutral mediator helps the parties reach a settlement without going to court. A solicitor arranging a mediation will prepare a concise position summary, identify key issues and interests, select a suitable mediator, and coordinate the session, often attending with the client. The mediator facilitates discussion, boundaries the process, and drafts or notes a settlement agreement or terms of settlement. It affects civil, contract, employment, and commercial disputes by offering an alternative path to resolution.
The solicitor coordinates the mediation, prepares briefings and position statements, and communicates offers and counter-offers. They arrange the mediator, manage confidentiality and privilege, and ensure any settlement is reduced to a binding agreement with formal steps for completion if needed.
