Tier 4 (General) appeals cover challenges to refusals of student visas under the immigration rules. An appeal is heard in the First-tier Tribunal (Immigration and Asylum Chamber) and may be followed by an Upper Tribunal review in certain circumstances. A solicitor acts for the appellant, preparing grounds of appeal, compiling evidence of educational arrangements and finances, lodging the appeal with the Tribunal, and representing the client at a hearing or in the exchange of written submissions. The process hinges on the Immigration Rules and human rights considerations where applicable.
A solicitor drafts precise grounds of appeal, assembles educational and financial evidence, and coordinates with the Home Office and the tribunal. They manage time limits, apply for any related relief or permission to appeal, and represent or instruct counsel at the hearing, aiming to persuade the tribunal of errors of law or discretion.
