This work covers criminal offences created by the Computer Misuse Act 1990, including unauthorized access to computer systems, unauthorised acts with intent to impair a computer's operation, and the unauthorised possession or distribution of malware. A solicitor in this area advises on investigations, reviews digital evidence, negotiates with police and prosecutors, helps obtain and disclose material, prepares defence or mitigation, and guides clients through complex legal steps in proceedings in magistrates’, crown or high courts.
What a solicitor handles in these matters
The solicitor handles statutory provisions, forensics requests, disclosure disputes, and the interplay with investigatory powers. They manage multi-jurisdictional data issues, assist with warrants, discuss mitigation for cybercrime charges, and navigate the evolving landscape of cyber offences, digital evidence, and potential penalties under the Act.
