Security measures covers the technical and organisational steps a business takes to protect personal data from loss, theft or misuse. A solicitor in this area helps craft and check safeguards—such as access controls, encryption, secure configuration, data minimisation, incident response plans, and DPIAs—and reviews contracts with processors and suppliers for compliant data handling and breach responsibilities. They advise on regulatory requirements under the UK GDPR and the Data Protection Act 2018, and coordinate with the Information Commissioner’s Office when needed.
Why this work is usually handled by a solicitor
Where security gaps arise, the solicitor explains the risk, the regulatory implications and the protections available through professional indemnity coverage, contractor oversight, and auditable governance. They ensure documented security measures are in place, including incident response and data processing agreements, so data subjects’ rights can be upheld and the organisation remains accountable.
