This area covers how adults with learning disabilities are supported within the social and health care system in England, including capacity, consent to care, safeguarding, and the legal frameworks that protect vulnerable adults. It includes court processes and regulatory safeguards when decisions about welfare and liberty must be challenged or defended. A solicitor in this field helps clients and their families navigate assessments, care planning, appeals, and applications to protect rights and access appropriate support.
What a solicitor handles in these matters
The solicitor handles complex capacity assessments, welfare decisions under the Mental Capacity Act 2005, safeguarding processes, deprivation of liberty issues, and the preparation or challenging of enduring powers of attorney or deputyships. They engage with local authorities, NHS bodies, and the Court of Protection, ensuring correct legal channels are followed and safeguarding protections are in place.
