Exceptional Results in a Complex Care Act Funding Case

We instructed Boyes Turner Solicitors (Reading) in February 2025 after a local authority had failed to carry out a Care Act review for over five years and had not reassessed our son’s care budget. Our son has no mental capacity and presents as a highly complex case, yet despite this, his needs had not been properly reviewed. As a result, we were forced to cover a substantial shortfall—running into thousands of pounds per month—just to maintain his care package, which was clearly unsustainable. From the outset, the team—led by partners Sue Bowler and James Pantling-Skeet—was decisive, strategic, and highly proactive. They took the complexity of the case entirely in their stride and dealt with every aspect appropriately and professionally. They drove the process forward at every stage, ensuring there was no delay or loss of momentum. Communication was consistently prompt, clear, and purposeful. A key strength was their decision to appoint a highly experienced independent social worker to carry out a full Care Act assessment. The quality of this report was exceptional and, crucially, they successfully persuaded the local authority to adopt this independent assessment rather than subjecting our son to a further stressful review process. Their advice and handling of the case significantly reduced both the emotional and practical burden on our family. They demonstrated not only legal expertise, but a clear understanding of the real-world pressures involved in caring for a vulnerable individual with complex needs. Most importantly, they delivered a tangible outcome. They secured backdated funding, increased both the care package hours and the hourly rate, and eliminated the ongoing financial shortfall we had been forced to cover. As a result, our son’s home-based care package is now sustainable for the foreseeable future. If you are dealing with a local authority that is delaying, underfunding, or failing to meet its statutory duties, I would strongly recommend Boyes Turner Solicitors. We would not hesitate to use them again.

Excellent advice and expertise

We approached Laxmi Patel for assistance in navigating the SEND EHCP process. Her advice and guidance was excellent. We were able to commission an educational psychologist report to inform our decision about whether to proceed with the EHCP process. Laxmi and Amber were efficient and compassionate throughout. The whole process was significantly accelerated compared to wading through this without professional advice. Ultimately we did not pursue the EHCP, and we welcomed this honest advice. Laxmi is a person of great integrity and skill, and I have recommended her to a number of people who are also struggling to navigate the complex SEND system.

We used Ellena Balshaw in the Boyes Turner Residential Conveyancing team for our house move, and she was simply brilliant. What should have been a straightforward transaction became far more challenging due to a difficult buyer who pulled out, returned, and then appointed an extremely slow firm on their side. Their admin-led approach caused repeated delays, with decisions unable to progress without solicitor sign-off, despite Ellie clearly communicating our fixed completion dates. At the same time, our sellers were keen to move quickly as they were leaving the country. Throughout the process, Ellie kept us regularly and clearly informed about where things stood, the position with both our buyer and seller, and exactly what we needed to do next. She also proactively liaised with our estate agents and other parties to keep everyone aligned, meaning we were fully prepared and ready to proceed ahead of others. I would highly recommend Ellie to anyone buying or selling a property.

We instructed Boyes Turner LLP in connection with our late father’s intestate estate, as they came highly recommended by Hooper’s International Genealogists. Initially we were advised by Hooper’s, that the procedure for a straightforward uncomplicated case such as ours would take approximately 9 months. That said we mentally allowed for a year. In effect it was all of 2 years before it was finally settled and that after copious inexplicable delays of one sort and another. We were dealing with a solicitor who only worked three days a week, who was frequently on leave without any cover except in an emergency, always at a time when immediate action was called for - thus causing further delays. And who was very slow on occasions in answering correspondence. We got the general impression that every possible delaying excuse was being employed after the property was sold and the monies paid into their account. As in, never mentioned prior, asking if we would like to place an advertisement in the London Gazette that anyone claiming to be owed money by the deceased come forward - this would run for a period of 2 months and one day. Why wasn’t this done months before? We were initially advised by Hooper’s that an insurance policy had been put in place to cover us in the unlikely event that a hitherto unknown claimant might appear, but had not been advised that this only applied for the duration of the legal proceedings. And that therefore, we were not covered. A clear case of not what was said, but what was not. So why after close on three months after the sale of the property which was tantamount to finalizing the entire proceedings, were we advised of the advisability of taking out a policy against the sudden appearance of any missing beneficiary? No doubt the pursuit of such action would have resulted in a further delay in final settlement! Finally and most painfully, settlement was made. Shortly afterwards we realized that no interest on either the contents of the deceased’s bank account or the property sale - for the 3 months - had been included! On querying this and after further chasing, the due interest was duly paid. No explanation was offered as to this omission despite our requesting one which in effect has been completely ignored. Had we not picked this up there is little doubt in our minds that this would never have been paid. Would we recommend this company - no way! Instead our recommendation should you choose to avail yourselves of it would be to go to your local solicitor and seek advice ensuring that the procedure be fully explained to you in its entirety before you take any further action Posted on the behalf of Colin
