Converting an existing SEN provision or statement into an Education, Health and Care Plan (EHC Plan) covers the process of pulling together education, health and social care evidence to secure a coordinated plan for a child's special educational needs. A solicitor in this area advises on eligibility, coordinates assessments, helps draft and issue the plan, and engages with the local authority, NHS bodies, and schools or colleges to resolve disputes or secure suitable provision. The work often hinges on deadlines, the right to an independent review, and the interplay between education law, social care assessments, and health input.
What a solicitor handles in these matters
A solicitor handles the statutory steps to convert a statement into an EHC Plan, including gathering professional evidence, preparing and submitting the evidence bundle, and negotiating the plan's scope and outcomes with the local authority and, where necessary, health bodies. They may also advise on objections, or representing parents or carers at education, health and care panel meetings, and ensure the plan reflects essential services and amendments that affect the child’s education and wellbeing.
