My case began after a recommendation from my solicitor, who referred me to Ison Harrison, specifically Mr. Jonathan Robson. During our initial discussions, he appeared to understand the matter well and advised that, even in the event of losing, my costs would likely not exceed £16,000. I was also informed that I had a strong case supported by witnesses and documentary evidence.
I was told that the matter could take some time to reach court, but I was not prepared for the process to continue for several years while legal costs continued to increase. During the course of the case, communication was often inconsistent, and there were extended periods when I received little or no update regarding progress.
At one stage, I was referred to counsel, Mr. Amardeep Dhillon, to assess the merits of the case. Unfortunately, my experience of this consultation was disappointing. Despite being charged approximately £2,000 for a one-hour conference, I felt that important aspects of the case had not been fully understood, and several key facts appeared to be misunderstood.
As the case progressed, I identified what I believed were errors in documents prepared for court, including issues relating to wording, figures, and dates. When these concerns were raised, I was advised that further meetings with counsel would be required to amend the documents, resulting in additional costs. I found this particularly frustrating as I believed these issues should have been identified and corrected before the documents were provided to me.
Another difficulty was the timing of communications. Important documents, often lengthy and complex, were frequently sent late on Fridays with requests for urgent review and response by Monday. Given the volume and complexity of the material, I found it challenging to provide meaningful feedback within such short timeframes.
Subsequently, I was referred to Mr. Ervin Shakaj. My expectation was that this would improve the handling of the case and potentially reduce costs. However, I felt that he did not fully appreciate the strengths of the claim and appeared focused on encouraging settlement rather than pursuing the matter through litigation. Throughout the case, I was frequently encouraged to compromise or abandon the claim, despite my belief that there remained reasonable prospects of success.
Communication under Mr. Shakaj's management also presented difficulties. Documents that had previously been provided appeared to be requested again, requiring me to resubmit substantial amounts of information. In addition, I often received emails requiring urgent responses while travelling abroad, making it difficult to manage the case effectively.
The most disappointing aspect of the matter was the outcome of settlement negotiations. We initially sought approximately £5,000 from the opposing party, yet ultimately reached a settlement requiring me to pay £35,000, despite the case never proceeding to trial. The opposing party's initial position was reportedly between £42,000 and £48,000, eventually settling at £35,000. Given the substantial legal fees I had already incurred, I found this outcome extremely difficult to accept.
Over the course of the matter, I paid approximately £20,000 in legal fees, only to be repeatedly advised to settle and abandon the claim. At no stage did I feel confident that my legal team believed in the merits of the case or intended to pursue it vigorously through the court process.
I continue to believe that my case had merit and that the UK court system provides a fair opportunity for disputes to be resolved. My dissatisfaction relates not to the legal system itself, but to my experience with the professionals involved in my representation.
