Outstanding support and a result against all odds

Engaging Higgs was my first experience instructing a firm of solicitors. I contacted them to outline the nature of my charity’s dispute and to request an estimate for amending the organisation’s Particulars of Claim (POC), which had been drafted incorrectly. I expected, particularly at an early stage of the engagement, and on the assumption that this was standard practice, that a solicitor would speak with me directly to ensure a full and accurate understanding of the issues based on the information initially provided. This was not the case. A significant portion of the initial fee quoted was used to review a batch of documents received from the defendants’ solicitors. An additional fee was required to complete the amended Particulars of Claim. Before Higgs was able to proceed with drafting the amendment, the defendants’ solicitors filed an application to strike out the claim, which the court accepted, in part because the amended Particulars of Claim had not been filed. It then became pointless continuing with the amendment. Although the advice I received on my charity’s position was helpful, the engagement was not as I expected. On reflection, I would have insisted on a meeting or direct conversation with the solicitor much earlier in the process. This would have allowed me to ask questions, clarify key points, and address any potential gaps in their understanding of the claim. It may also have ensured they fully appreciated the merits of the case beyond what could be conveyed through documents or brief email exchanges. Additionally, I would have stressed receiving the amended POC was a priority as initially instructed. I noted that the defendants’ solicitor adopted a highly creative approach in constructing arguments to undermine or dismiss our claim, including advancing assertions and inferences that were, in my view, unfounded. While I fully appreciate that solicitors must act with integrity and cannot engage in any form of dishonesty, which I would never expect or want, I had anticipated that my own representatives would adopt an equally robust and imaginative approach in identifying legitimate arguments to strengthen our case. I believe this approach could have been explored had direct conversations taken place.

Setting aside a court order for sale

We instructed Higgs Solicitors back in June 2025 after finding ourselves( and 2 other sets of neighbours, three properties in total) in a legal tangle between investors and builders of whom we purchased our homes from back in January 2015. We was presented out of the blue in May 2025 with court orders to allow these investors to sell our homes from under us, this has been such a legal tangle that even the solicitors hadn't come across a case like this where an investor turns up nearly 11years down the line to say they own our homes. They have kept us informed of proceedings through out and given us the reality outcomes, whilst putting all their efforts into getting the order set aside. The reality of being made homeless through no fault of ours has been unreal and hard to put into words, however Nyree Applegarth, Zahra Zafar and the rest of the team have been so supportive and sympathetic towards us and never given us false hope. They fought hard to get us the desired and right outcome. Our first case was 21/8/25 were they managed to get an adjournment because of irregularities, the second case was 4/12/25, I will never be able to put into words how grateful we are for their support and help in getting us justice and the order set aside. Now they are helping us prepare the next battle and I have every faith in them that they will do their best for us.

I would not recommend this company. I was billed for the initial meeting and “advice” that I had not requested and which was of no value to me. When I queried the very substantial bill Higgs were totally inflexible. The whole experience has caused me to lose faith in solicitors and was very stressful.

Founders first MBO.

This was our first MBO, and it was a steep learning curve. Higgs helped guide us through the legal side of the process and were available when we needed clarity or reassurance. They produced strong documentation and helped us protect our position as founders. Invaluable Help with Corporate Transaction

I worked with Jamie Partington and Richard Freeman at Higgs as the Buyer in an MBO transaction, and I couldn't have asked for better advisers throughout the process. This was a complex transaction involving a US seller, extensive SPA negotiations, transitional licensing arrangements, regulatory considerations and a number of moving parts that evolved right up to completion. Jamie and Richard were consistently responsive, pragmatic and commercially focused, helping us navigate challenges without ever losing sight of the bigger picture. What stood out most was their ability to balance technical legal advice with practical business judgement. They took the time to understand the commercial objectives behind the deal and were always willing to discuss options, pressure-test positions and find workable solutions. Over the course of 5 years, we appointed Higgs & Sons to act as a professional deputy. Unfortunately, our experience was consistently marked by poor communication, significant delays, and a lack of professionalism. Despite the firm charging approximately £12,000–£15,000 per year for what were simple administrative duties, timely responses to calls or emails were rare. Although Nicholas Moxon was named as the appointed deputy, we did not receive a single email or telephone call from him during the entire period. All communication was instead routed through Claire Whittall and Katie Chance, both of whom were frequently unresponsive and, at times, discourteous. On one occasion, after receiving no replies, I drove nearly two hours to the firm’s office, only to be handed documents by a receptionist while the relevant staff members declined to meet. The deputyship accounts were also significantly behind schedule—approximately two years overdue. Given the level of fees being charged, it is essential that these accounts are scrutinised by the Senior Courts Costs Office to ensure they are legitimate and proportionate. Following my mother’s passing, we expected a degree of sensitivity and efficiency. Instead, even simple enquiries regarding arrangements for a modest funeral required repeated follow ups. The funeral directors were not paid promptly, and we were again left to chase for updates. Despite the minimal communication during this period—amounting to only a few emails—Higgs & Sons sought to charge £3,389.40 for “extensive involvement.” In correspondence, Katie Chance stated: “Following your mother’s death there was extensive involvement to assist the executors in understanding the current position and to try and progress matters. The work completed from the date of death to date currently stands at £3,389.40… However, given the value of the estate, I am happy to agree to a 10% reduction of these fees as a gesture of goodwill.
